Latest sex tape scandal is, ta-dah!, a threesome, count ‘em three. Some. The video purportedly features “Grey’s Anatomy” star Eric Dane, his wife actress Rebecca Gayheart and former beauty pageant queen Kari Ann Peniche , hanging out and waiting to have sex, according to TMZ.com.

“From what I’ve seen it’s a naked tape, not a sex tape,” said Marty Singer, the legal eagle for Dane, 36, and Gayheart, 38. “At most it’s 3 people maybe wanting to have sex.” Singer said he’ll slap anyone who publishes the video with a lawsuit.

Peniche, who was stripped of her Miss United States Teen title when she posed nude in Playboy, told Singer she had no clue as to how the tape got out. “I had nothing to do with it.”

Well maybe not intentionally, Sister. Us Weekly reports the zexy tape surfaced during an official investigation into Peniche’s alleged sex-for-hire bidness. Peniche, 25, was treated for sex addiction on Dr. Drew’s Celebrity Rehab and was kicked off for stealing from her roommate, country crooner Mindy McCready.
